As the US Citizenship and Immigration Services agency looks to make a number of regulatory changes to the H-1B visa program, some caution that the proposed rules will actually make it more difficult for employers to hire overseas talent for key roles within the tech industry, especially AI. Partner Bo Cooper spoke with Bloomberg Law for an article titled, “H-1B Overhaul Plan Risks Undermining Biden’s AI Workforce Policy” and noted that the proposal would put agency officials’ focus on broad labels of positions and degrees when adjudicating petitions, which would potentially lead to petition denials for workers who are qualified under the statute.
