How Employment & Family-Based Immigration Will Change in 2021

This year’s change in administration will bring adjustments to the entire immigration system. President Biden has expressed his intention to pursue immigration policy and regulatory changes over the first 100 days of the administration. President Biden claimed that he wants to “modernize the immigration system” and focus on implementing changes to employment and family-based immigration policies.

Restructuring the Employment Immigration System

Biden’s new employment immigration objectives are to grow the U.S. economy by eliminating employment-based visa backlogs, unused visas, and reducing wait times. The new bill also wants to eliminate per-country visa caps to give foreign nationals more flexibility and opportunities. Biden believes that these changes can “stimulate regional economic development,” and will incentivize higher wages for non-immigrant, high skilled workers to prevent unfair competition with American workers.

We can also foresee additional benefits and protections for the dependents of foreign national workers, primarily those with an H-1B visa. The bill wants to increase the opportunities for dependents of H-1B visa holders by allowing them to obtain work authorization. This is an expansion of the current H-4 Employment Authorization Document (EAD) guidelines, which currently doesn’t allow dependent children to obtain work authorization.

Improving the Family Immigration System

Biden’s proposed bill wants to reform the family-based immigration system by clearing backlogs, recapturing unused visas, eliminating lengthy wait times, and increasing per-country visa caps. The bill also wants to eliminate the “3 and 10 year bars” that keep families apart. The immigration bill wants to add more support to families and eliminate discrimination against LGBTQ+ families.

Overall, the Biden administration wants to make the immigration system more efficient by cutting down wait times and reuniting families. With a more efficient and supportive system, the family immigration system can help more families stay together in the U.S.
